Minor Changes to Housing Policies - January 2025
Overview
The Council's housing management department has a range of policies in place related to the homes we manage. The Council reviews these policies as part of a regular programme to ensure they are up to date and relevant.
On occasion, these reviews determine that minor revisions or additions are required to ensure they are up to date, meet residents' needs and relevant legislation.
The Council has recently reviewed three such policies:
- Housing management freehold disposal for residential buildings let on long leases policy
- Housing management former tenants arrears policy
- The succession and assignment of tenancy policy
In each case only very minor amendments were felt necessary. Below you can read more information on the changes made against each policy and review a copy of the draft policies.

Housing management freehold disposal for residential buildings let on long leases policy
This policy applies to buildings that are solely occupied by leaseholders, and where they choose to take on the freehold of the property from Kensington and Chelsea housing management.
The policy has recently been reviewed and we felt the only change needed was a single line, for clarity, around participating leaseholders and non-participating leaseholders. “If the freehold is offered to leaseholders, at least 50 per cent of leaseholders must participate or 100 per cent if the building consists of two flats only, unless the non-participating leaseholder(s) will give written permission for the participating leaseholder(s) to continue.”
The policy applies to fewer than 10 buildings across the borough, where all the flats have been sold on long leases.
Housing management former tenants arrears policy
The former tenants arrears policy provides clarity about how we recover debts from ex-tenants after they have left their property.
The policy was recently reviewed and we felt no changes, other than internal job titles, were needed. As the policy is guided by legislation there is little scope for amendments, however, we welcome any comments from residents.
The succession and assignment of tenancy policy
The succession and assignment of tenancy policy covers what happens when the lead tenant of a property dies and provides clarity about whether other household members can take over the tenancy going forward.
The policy has recently been reviewed. It is rooted in legislation and statutory requirements, leaving limited scope for amendments to its core provisions. Very few changes have therefore been made to the core elements of the policy. The most significant change is the inclusion of granting succession rights under discretion to vulnerable residents including those affected by the Grenfell Tower tragedy.
